Are we talking about a certain "M" here? He sold me an MC8 shell that turned out to be burned out in the back. I called him and we agreed that I would stop payment on the check. I stopped payment on the check and he waited two years then cashed it. Called him on it and never get called back. He never came to get his burned shell so I had to pay to get it scrapped. Fortunately for him and unfortunately for me the amount is not large enough for me to hassle with legal action. |

All right. Here is my reply to Kristine. "Kristine, the buffer switch is mounted in the rear off the mechanism that controls the throttle opening. When you let off the throttle, the buffer switch contacts close and let the Jakes operate thru the control switch that you have up front. If you have the throttle open, even just a little bit, the Jakes will not work. You do not want to be accelerating and braking at the same time. Most Jakes are set up with a high. low, and off. It is very nice when descending long grades and full on is too much braking and all the way off is not enough. It would be very easy to convert yours to hi-low- and off. Next time you are in WV I will be glad to do if for free. Richard" |

So, I guess I'm confused. Did you pay $2000 for a worthless bus? Or did you have to do $2,000 worth of repairs on a bus he sold you? I got the impression he sold you a bus that burned up after you got it, but I wasn't quite sure, and I'm not sure if you meant "burned" as in actual fire, or "burned" as in part failure in general. If you stopped payment on a check, he should not have been able to cash that check, ever, and your bank should be responsible for refunding your money. Do you mind explaining in more detail either here or privately? |

I'm with Christy. I doubt any bank will cash a 2 year old check that had a stop payment placed on it. If his bank did cash it and he spent the money, after the his bank figured out it had a stop payment on the check they would get the money back from him. |

It wasn't just "cryptic" it was irresponsible to the point that I'm suprised Ian let it get entered. The comment was blatantely subjective and if I were "M" I would be serving papers to Rjmule.Let me tell yu Rjmule, It appears to me that you don't know your Colon from your Coranium about buses if you couldn't see something as obvious as what you are eluding to.I love this board And I love the "Magazine" I may be wrong but I don't think "M" is gettin rich by the hard work that it takes to put out the publication every month and I hope your assinine rantings don't hert the magizine. |

Stop payments as I found out the hard way are only good for 6 months unless renewed. The acceptance of a check is totally up to the accepting teller. If the stop payment order was not renewed then you are out of luck. This is what Bank of America told me last year. If you want the check to be invalid after a period you should write "NOT VALID AFTER ..." clearly on the check. This was told to me by BofA. "M" told me that he was not aware of the issue of the cashing of the old check and would "investigate" and get back to me but subsequent phone calls resulted in "not in" or "give him a message" or his voice mail. Never got back to me. Like I said the amount was not large enough to waste more of my time or more money to collect. That being said here is my story. I got sold a bus shell that was supposed to be good but had structural problems that was caused by a serious fire in the back end of the bus. He agreed to take it back and I told him that the check was stopped. He said he had someone who was going to pick up the bus however this never happened. After a few months he ceased contact, until two years later when the check was cashed. Subsequently the yard owner where I stored the bus put a lien on the bus and dismantled it to get his space back. This put quite a strain on what was a good friendship. I was not able to make a good buying decision due to the lack of information. I may have even begrudgingly have accepted "you bought it sight unseen and its yours now, good luck". I just believe that when you agree on something you should adhere to it even two years later. I usually buy things sight unseen based on trust. I bought my MC5 that way and I bought a Setra I am currently converting the same way. I have bought 3 cars on Ebay worth more than $20k each. The only bad experience I ever had was with "M". I had a fight with my wife over this as I insisted that because "M" seemed like an upstanding guy with a reputation to protect that the situation with the check would be rectified. To this date this is a sore point in our relationship. I now never trust something I cannot see beforehand. Live and learn. (Message edited by du1jec on February 17, 2007) |

Not being a party to this in any way, it appears that Jojo is not the poster who owes the apology! Noah Webster published a dictionary. The comment about the stopped check is exactly correct. The holder of the check KNEW that it would be immediately returned with a "payment stopped" stamp on it, so he didn't deposit it until he was sure the stop order had expired. I have a problem with a bank accepting a two year old check, and another bank clearing a two year old check? That said, we all caution "newbies" to have their prospective purchases checked out by qualified bus mechanics. There is also an old saying that "you can lead a horse to water, but you can't make it drink." From the sounds of the above, now that its all out in the open, the seller knew there was a hidden problem, and didn't tell the buyer? Most of us buy well used buses, knowing well what they've been through. I am not saying in any way that a seller is liable for an engine failure a couple of weeks after selling a bus as is to a buyer who has driven it to a shop and had it checked out by a competent mechanic. What I am saying, is that wolves in sheep's clothing should be identified. There have been several of this type of issue posted here over the years, with people "home sick," "moved," "gone out of business, then re-appeared somewhere else," after taking payments and not delivering! We should know who 'they' are, so we don't get taken also! This has just taken the lid off the worm can, but. George |
