Well, I broke my Reservation Rule #1 when I made plans to go to a certain bus convention in Laughlin Nevada......I used the Group Number. I've found many times, that group numbers don't always give you the best rate. ANYWAY.....I had planned to go there in the Jeep, boat in tow, do a little bussin, a little fishin..etc. So when the convention was moved, I pondered keeping my room at Don Laughlin's Riverside Resort......Luckily, this morning I called. My room had been cancelled (gee, thanks for the notification Don), and was told that no charges were made on my credit card.....EXCUSE ME!?!?!..."....uhhhhh.......errrrrr...Oh, I see here charges WERE made, but a refund was issued in November.".......Once again...EXCUSE ME?!?!?! I'll condense this story...."blah blah blah lost blah blah missplaced blah blah blah we'll get back to you on this blah blah blah. No animosity towards the organizers of the Bus Convention mind you, but if anybody ever sees me at DON LAUGHLIN'S RIVERSIDE RESORT IN LAUGHLIN NEVEDA, I'm only there hunting down Don Laughlin to get the money he owes me. |

Oh he's easy to spot...... He lives in the Special Penthouse on the top and either flies around the area in his chopper or drives his cream Rolls Royce Convertible, which funnily enough has dealer plates on it!!!!!! If he knows you're gunning for him, you should look East from his casino and if you have good sights on your gun, you may just see the entrance to his "Fall-out Shelter" in them thar hills....... HI SLO A Flare gun works good. You mite not get your refund but you will get one good BLAZE out of it...HE will not have to worry about his tailpipe and his won,t be CREAM NO MORE he will CREAM his pants. Try it it works just find. HAHAHAHA |

SLO - If you haven't already, dispute the charge with your credit card company, and then let them work it out w/ the Riverside. FYI, I've stayed at Don Laughlin's place numerous times over the last twenty years or so, and have never had a problem with their billings. FWIW, RJ PD4106-2784 Fresno CA |

I am confused, though. Did they or did they not give you a refund? If they didn't, and still refuse to, like RJ says, a simple chargeback request to your CC company will take care of it. Peter is right, you can't mistake Don when he flies in low in his black helicopter! Scott |

RJ, I don't want to dispute your suggestion, however, the charge to the credit card sounds like it was legitimate. It's the refund that appears to be in dispute. The charge card company will only act if the credit card holder tells them that there was some unauthorized use of the card or that there were some other mitigating circumstances, such as a double billing. To simply tell the charge card company that the vendor is not refunding money which was charged legitimately to the card doesn't violate the cardholder agreement. In other words, SLO would have to lie in order to get the credit card company involved. And people never lie in order to get what they want, do they? Regards, Ian www.busnut.com |

Technically, not a lie. By federal law, the vendor is not allowed to charge the card until the day the reservation becomes effective, so that would be the 1st day that he was supposed to have been there. Therefore, if he cancels the reservation before that date, then the card never should have been charged. Same as buying something mail-order or over the phone or on the internet. Legally (Consumer Credit Reporting Act),they cannot charge the card until the product leaves their possession. Truth is, very few vendors (businesses in general)follow the letter of the law when handling credit card sales. Even if they have a very thorough credit card charging and refunding policy, the question then becomes whether or not the consumer was properly informed of it. That is seldom, if ever, the case and the vendor enjoys no protection if they didn't. And then, there are different interpretations (by courts) of the law. |

I am really confused now. Jmaxwell are you saying there is a federal law that says a reservation does not become a transaction until the day he/she is suppose to show up. I thought a reservation was a guarantee of a service, at a certain agreed upon time, a transaction you might say. I give you twenty bucks to hold my place, but I must get there on time or I lose the twenty bucks. We might also agree that if I give you five days notice, I will get my money back, but that needs to be agreed to prior to the transaction. In this case, it sounds like the guy got his money back because Mak notified the Casino of the cancellation in a timely manner. As a former RV resort owner, I agree with Ian, and I think a lot of people are mistaken about their ability to clear charges on their credit card bills. In every case that a credit charge was challenged, I was the one who chose to refund the deposit, although I had in fact held up my end of the bargain, and the credit card company agreed to abide with my decision. Only once did I force compliance, and that was when a customer admitted she never cancelled reservations, because it was easier to challenge her statement. In that case, I took the money, and boy was she pissed! Apparently the couple never knew how far they would travel that day, so she would make five or six reservations each day based on distance and whether the campground had a toll free number. |

There are some differences here. A reservation is a promise of service. That doesn't hold water at the federal level, but some states have laws on it. A Guaranteed reservation is one that is a promise backed by a promise - a promise of a room in exchange for a commitment of money. Conditions like a time to cancel and other factors come into play. If a credit card was given to guarantee the room, and it appears it was - then this is a transaction (value exchanged both ways in some form), not a promise. Fine points, but still important. A credit card company WILL help get money back when there is some proof that the vendor did not perform - in this case, the reservation was cancelled by the hotel/resort/whatever. I have experienced AMEX and Mastercard on this subject. They idn't have any problem once I showed them proof - even a cancellation number can help. Hope you get your money back without difficulty. I really hate these bums that charge your card to increase their months revenue when the service isn't due for many months! That would be a no-no in the accounting world! Doug St Louis '83 MC9 |

Well Well Well.....Seems I opened up quite a conversation here. Let me recap, and probably confuse things even further.... I said "Credit Card".....er....I should have said "Debit Card". That being said, they still charged my card and I agreed to that at the time I made the reservation. At that time, I asked for the cancellation policy, and was told 72 hours before check-in. OK, now, I only brought this up to warn others about 2 things.... A) My reservation, or more to the point, my entire planned stay was PAID IN FULL, and cancelled without my authorization, nor with the Hotel contacting me!.....that ticked me off. B)I was not given an automatic refund to my "Debit Card". (The cancellation happened November 27th) If a credit would have come through, I would have seen it (I bank online, and check my account at least 3 times a week, not through snail mail monthly statements). So, the whole affair reminds me of paying taxes.....They say they need the money for one thing, then without your say, they do something else with it. In this case, for whatever reason, they merely failed to refund my money, or contact me and notify me I had a refund comming! I guess it's a good thing I didn't show up in April to be told I had no room.....Can you spell BALISTIC?...(what was that movie, the out of towners with Jack Lemon..."I'm takin names here!!!"....LOL) Just another fly in the oatmeal of life. This morning, I logged on to my bank and there was my refund.....No call back from the hotel as promised, but I sorta expect that these days, and that is the sad part of life. Indeed, SLO has nailed the proverbial nail on the head when he states "I broke my Reservation Rule #1". I'll take his self-fulfilled prophecy and create my own Reservation Rule #1 and refer back to this thread before I ever break it! By the way, when I made my reservations at the Caverns Inn, Karen Landis, who couldn't have been nicer, told me I could cancel my room up to the day before, without charge. With all the bookin' an' a cancelin' an' a bookin' an' a cancelin' going on around this event these past few years, that was good news. As long as you're going to the Riverside to collect your due, SLO, why not drop over to the Grand Canyon Caverns and say hi! Ian www.busnut.com |
